Do The Court Closures Help Fight A Pending Traffic Ticket?

The answer briefly is yes.  Generally, the longer it takes to resolve a case, the better chance you have for a dismissal.  Over time, papers are more likely to get lost, memories more likely to fade, etc.  So overall the closure of traffic court is helpful for your case.

With that said, it does not mean you will beat your traffic ticket, only that your chances are better.  The governmental closure of the traffic courts was done to reduce the spreading of the Coronavirus and is a legitimate reason to do so.

We had a few clients call us asking why there case cannot be dismissed for failure to prosecute or violating the speedy trial rules.  Neither of these arguments are availing.  The court is allowed to administratively change your court date and, in New York, the speedy trial rules do not apply to traffic ticket cases.
