How Much Is A Speeding Ticket In NY?

We are often asked the question: “How Much is a Speeding ticket in NY?”.  The literal answer for a first conviction is that a New York state speeding fine costs between $45 and $600. For speeding 1 to 10 mph over the limit the range is $45 to $150.  For speeding 11 mph to 30 mph, the range is $90 to $300.  Finally, for speeding 31 mph or more, the range is $180 to $600.  For a second speeding conviction, the maximum fine can be increased by up to $150 and for a third, it can be increased by up to $375.

Of course, these ranges of fines do not include the $88-$93 additional New York State speeding fine surcharged imposed on all moving violations.  Additionally, it does not include the Driver Assessment Fee that is imposed on motorists who accumulate 6 or more points on their licenses.  This fee is $300 for 6 points and $75 for every point above 6.

However, there are many other NY speeding ticket costs.  For example, it is not widely known (or enforced) but a judge can also impose up to 15 days in jail for a speeding 1 to 10 mph speeding ticket, and up to 30 days for 11+ mph speeding ticket.

New York Speeding Ticket Fines and Points

On the other hand, most of you know that speeding tickets result in points being added to your driver license.  In the state of New York, a speeding ticket carries a total of 3 to 11 points.  Below is an overview of NY speeding ticket points:

Speeding 1 to 10 MPH: 3 points

Speeding 11 to 20 MPH: 4 points

Speeding 21 to 30 MPH: 6 points

Speeding 31 to 40 MPH: 8 points

Speeding 41+ MPH: 11 points

 

Beyond the points, another speeding ticket cost is that it can result in a license suspension or revocation.  Some judges will suspend a motorist for just one 8-point or 11-point speeding ticket conviction.  Some will suspend for two speeding convictions.  The DMV can suspend your license if you accumulate 11 or more points within 18 months (from speeding convictions or otherwise).  Finally, three speeding convictions within 18 months will result in an automatic and mandatory 6-month revocation of driver’s license.

Another cost of a speeding ticket conviction involves your automobile insurance rates.  By law, a New York insurance company cannot raise your rates for one speeding conviction of 15 mph above the limit (or less) if you have an otherwise clean record.  For a higher speeding ticket or multiple convictions, however, your auto insurance rates can be hiked.  The only option to address a hike is to take the Driver Safety Class that takes 10% off your insurance rates.

  • I am 17 and have a junior license. I was on I-87 and was ticketed for going 86 in a 55. I didn’t realize I was going as fast as I was and I was going with the flow of the traffic. What do you think I should do and what will the consequences be for me

  • I was following the flow of traffic and a lot of cars were ahead of me. Cop pulls me over for going 78 in a 45. I didn’t realize the bridge speed limit was 45. officer was not nice at all. Should I just pay the fine or fight.

  • I got a ticket for speeding 70 in a 45mph in a passing zone while trying to pass a vehicle that was driving erratically. The other driver sped up and was swerving i got scared honked the horn then sped up and passed him. I’ve never had a ticket before in my life. Or ever been in any kind of legal trouble.

  • I got pull over going 57 in 40 speed limit on Westchester Ave White Plains but by a Harrison police offer. I don’t think I was going that fast but I don’t know for sure. I was making a left turn on green light so I speed up to make the turn, that is where the officer stopped me. Is it worth to plead not guilty? If plead not guilty, what is my defense and possible outcome? Thank you!

  • Hello i need some advice on what to do i got pulled over and received a traffic infraction for going 83 in a 55 but the officer pulled me over 5 to 10 minutes later then the ticket says and i was also in a completely different area then the ticket states what should i do the is my first ticket i have ever received and i don’t know what to do.

  • According to the officer, I was going 51mph in a 35mph speed limit zone. I was on a 55 mph zone initially and was on an inclined road. I was trying to apply brakes to reduce speed. I told her that I was applying the brake. She didn’t issue me a ticket but rather gave me a supporting deposition. I was driving a rental car. I am not sure exactly what to do because I am leaving the country in a few days. There is a date mentioned in the disposition for returning it via mail. However, if they reply back I won’t be able to receive it. Any suggestions?

  • Hi, I am charged overspeeding at 90 on a 55 limit State Route 12 County of ONEIDA.
    I am not sure at what speed I was driving but there are other cars as well. However I got pulledover. I have Connecticut license.
    How much fine I will be charged along with other taxes & fees? Any way I can reduce the penalty & points?
    Should I plead guilty or not guilty?

      If you are found guilty, you will be given 8 NY points, a fine of around $300-$400 plus a $450 Driver Assessment Fee. Based of our experience in Oneida County, if you plead not guilty, you likely can obtain a more favorable result and save money.

  • I got pull over doing 55 in 40 speed limit on Westchester Ave Westchester. There was a car in front of me doing the same speed and he slow down when he saw the police officer. I was on the left lane doing the same speed and slow down as well. He however did not pull over the other car instead he pull me over. I tried to explain to him why I wasn’t aware of the speed limit. I gave him my PBA card as my brother in-law is a NJ Detective and I also live in NJ. His respond was ” I am not giving you a break because you argue with me.” I have dash cam on my car and it show what happened.
    My questions are:
    1. Should I plea not guilty? If I do, what would the court charge and fine will be?
    2. If I plea guilty, what would be the fine and any other fees? I know I will get 2 point in NJ and I do travel to NY a lot. Also, my insurance will not go up as I have good driving record and they have violation forgiveness.

    Any advise would greatly appreciate it.

      1. Should I plea not guilty? If I do, what would the court charge and fine will be? Yes. Try and get this reduced to a less serious offense which carries 0 or less points. The fine will likely be about $200

      2. If I plea guilty, what would be the fine and any other fees? I know I will get 2 point in NJ and I do travel to NY a lot. Also, my insurance will not go up as I have good driving record and they have violation forgiveness. See above.

  • Hello. I got a ticket for Barre NY going 76 in a 55 by a NYS Trooper. The Trooper was very polite and was kind enough to reduce it to a 70 in a 55 for me. I know it doesn’t matter, but it was bright enough with the sun in eyes that I couldn’t see my dash and I honestly didn’t know I was going that fast. I am trying to get into a police dept right now and I am hoping to plead this down a bit so that it isn’t quite so bad on my record. What would be the best option for me?

      Because you already got a break, I doubt that you will get this charge further reduced. In fact, you risk the prosecutor seeking to amend the case back to the original speeding charge.

    I got a ticket once for going 87 mph in a 55 on Interstate 87 in white plains. Ridiculous because no one goes under 80 on that road and it could easily handle 100+ mph. Now have 8 license points, got fines 425 dollars, and am on 6 months probation. Insanity.

    27 years old. Just got a 86 in a 55. It is literally exactly 31 MPH over. The officer was also nice enough to give me an extra ticket for an expired registration as well as a picture of his speed gun showing 86 MPH. I feel like I am screwed. Its so unfortunate because its a highway where everyone regularly goes 75/80 and it was at 10:30 am with no traffic

  • I was traveling 79 in a 55mph zone on 81S in Broome county, and received a speeding ticket. I live in NJ and have a NJ license. And have no ability to appear in Broome County traffic court in 1 month.

    Broome county has a “Traffic diversion program” where a motorist may pay a non-refundable fee of $400 to Broome County and then “if accepted” will be given 45 days to complete a 6 hour traffic safety course approved by the New York State Department of Motor Vehicles. Which results in he motorist’s traffic ticket will be dismissed, there will be no fine or surcharge, and there will be no record of conviction on the motorist’s driving record.

    Is this worth pleading not guilty and participating or should I plead guilty?
    I think (correct me if I am wrong) I would be assessed only 2 points for my moving violation out of state– not the 6 NY would get if I had a NYS license. And subject to whatever fines they assess to my ticket. And the 2 points could be reduced with NJ DMV approved driver course after my guilty plea?

  • I was traveling northbound on I-87. I was pulled over off of exit 8 on I-87. This is where the speed limit signs go from 55 to 65. I took drivers ed and was always told the speed limit begins when you see the sign. Meaning the speed would now be 65 instead of 55. I was ticketed for going 79 in a 55, however the officer wrote down an estimated guess of speed on the ticket as well as saying he got 79 on his radar. I have only been pulled over once before so I wasn’t entirely sure what to do. The officer asked for my registration which was in a folder with my insurance. When I gave him the folder, he told me just the registration. Having only been pulled over once, I was a little lost on which part was registration. He accused me of “playing games” and told me to “stop acting like I’ve never been pulled over going 80 on a highway before.” This first time I was pulled over was in my hometown and that officer talked me through everything about registration being in a folder and accepted it. He never gave me a ticket. The officer today seemed agitated about me not knowing exactly what to do. Should I fight this ticket due to the speed limit or plead guilty?

    This is a hypothetical question..
    Giving the following facts..leaving Cicero going to Syracuse on I-81.
    Posted speed limit is 65.
    Entering the Syracuse area there are speed limit signs of 55 and then down to 45.
    Them signs are only posted on the right hand side on the 3 lane I-81.
    If i was to be pulled over in the 45 doing the what i thought allowed 65 (because there was no chance for me to see them other signs due to trucks driving in the right lane and blocking my view) what are my odds to get the ticket dismissed ??
    I already spoke to the police in Cicero about and they couldn’t help me

      I doubt that the “truck blocked my view” defense will win. Often there are two (ore more) speed signs and judges are not too receptive to this argument in my experience.

  • Hi – on Saturday, I got done for 77/55 in the Kingston area of NYC. I truly thought the speed limit was 65, given a nice main road and a lack of speed limit signs. I am also Irish, despite being a city resident, and rarely drive (rental car). Furthermore, at the bottom of the ticket, the timing is incorrect (off by 1hr) and what the officer claims I said is untrue, I said something similar, but the quote on the ticket is saying is completely misleading. Given, I am based in the city, I will need to take 1 day off work to go to court, and pay to travel there, both cumulatively will add up to more than the ticket I believe. What do you recommend?       You should fight this ticket as it carries 6 points, roughly a $250 fine, a $300 Driver Assessment Fee and, if you ever get a car, an insurance increase. If you cannot return to the Kingston area, you can retain a NY traffic lawyer to appear for you.

  • Hi. I was caught speeding in Dryden, NY – new to the area and missed the sign – officer reduced the ticket to 1110a. No information about the speed or speeding is mentioned on the ticket. My driving record is clean. 1) Is it worth pleading not guilty and trying for a reduction? 2) Is it true that insurance cannot raise premiums with 2 points on a ticket if there are no moving violations within three years? 3) Is it even possible to plead down in Dryden town court?

    I received a speeding ticket in Dec 12 2016 for a speed of 84mph in a 65mph. I pledge not guilty by sending the ticket by mail. I haven’t received any date for court, I called the appointed court and they told me they were waiting for a court date (called about 9month ago and again 2 weeks ago)… For how long a ticket is valid?

      This ticket carries 4 NY points and will transfer as 2 NJ points. I recommend fighting it as this will likely allow you to save points. If you cannot or do not want to travel back there, then you can retain a NY traffic lawyer to appear for you.

  • I received a speeding ticket for going 81 mph in a 65 mph zone. However, the state trooper was in front of the me the entire time. He was several cars in front of me in the passing lane. After I had already moved into the middle lane, I noticed he turned his lights on but no siren. When I was in the far right lane he was in the middle lane with his lights on but no siren and was traveling faster than me. I was attempting to exit the interstate and was in the slowest lane with other cars going faster than me. I slowed down thinking he was responding to a call in an attempt to exit the interstate. Especially, since there were cars in front of him and behind him and in front of me and behind me making it difficult for anyone at that point to exit the interstate. However, he sped up faster and then crossed into my lane cutting in front of me and slammed on his brakes in front of me then pulled onto the shoulder. At this point I realized he was trying to pull me over and I pulled onto shoulder in front of him. His immediate response when pulling me over was why I was driving so slow in speeding traffic and I expressed that I was very upset with how unsafe and aggressive his driving was since I had children in the vehicle. He would not immediately tell me why he pulled me over. This is my first speeding ticket and the officer’s driving scared me as I thought he was going to hit us with his car.

    I received a speeding ticket in Elma,NY for going 81 in a 65mph zone. I sped up to get around car and get back into right lane. Officer wrote he “first observed my speed and then confirmed it by radar”.
