A reader recently inquired whether unsafe backing is a moving violation. The answer is yes. This ticket carries 2 points is most commonly issued in New York toll plazas for motorists backing out of clogged toll lanes (although I have seen it on local roads as well for motorists backing up a long distance or through intersections).
Similarly, it is a 2-point moving violation to exit a highway by other than an exit ramp. Typically, you see this unsafe maneuver when the highway is congested and impatient motorists try to return to the service road by reversing up the entrance ramp.
Both of these tickets carry roughly a $120 fine. If you have a clean record (no other accidents or traffic convictions), you probably don’t want to hire a lawyer to fight this type of ticket.
