The Problem: Motorist with 27 separate charges requiring appearances in five different court venues, including criminal court in Manhattan, during the period between December 2003 and December 2005.

The Scenario: Develop a comprehensive defense for these tickets such that our client obtained the minimum amount of points and, more importantly, avoided a suspension or revocation of his license.

The Result: Through careful planning and our vigorous defense work, we were able to obtain “not guilty” findings in 20 out of 27 of those cases. Of the seven cases where a “guilty” finding was returned, only five of those convictions resulted in points being added to our client’s driver’s license. As a result, our client is able to continue in his livelihood as a professional driver without interruption.

The Problem: Driver’s license in jeopardy due to accident involving a fatality.

The Scenario: Our client was a typical motorist who found herself in a very difficult situation. Our client had been called in for a safety hearing to determine the facts and circumstances surrounding a fatal accident in which she was involved and as a result of which a pedestrian was killed. The purpose of the safety hearing is to determine what action, if any, should be taken on the driver’s license. Such hearings can result in suspension or revocation of the respondent’s driver’s license, as well as high fines. Naturally, our client was very upset about having been involved in such an incident.

The Result: After meeting with our client to discuss the facts and circumstances of her case, we were able to help our client talk about the events leading up to the accident in a way that was coherent and credible. As a result, we were able to then present her side of the situation so that no action was taken against her license.

The Problem: Taxi Driver with too many points for Taxi & Limousine Commission (“TLC”) purposes.

The Scenario: Our client was a professional livery driver who had the misfortune of accumulating a high number of points on his license. Due to logging a high volume of miles and some bad luck, he accumulated points on his license that jeopardized both his New York and TLC licenses. In New York City, professional drivers are governed by two sets of rules – from NYS and TLC. Our client was facing a TLC hearing to determine what action, if any, should be taken with regard to his Class E license. If handled improperly, such hearings can result in a suspension or revocation.

The Result: By meeting with our client and discussing factors such as the date of each violation, the nature of each violation, as well as any past driver safety courses completed, we were able to develop a strategy which resulted in successfully preserving our client’s privilege to drive a livery vehicle – and, hence, his ability to make a living.
