Suffolk County Red Light Camera Tickets

Suffolk County has followed Nassau County’s lead and installed numerous red light cameras. These tickets are $50 each but do not carry points or negative insurance consequences.

  • At Rt 25 and Rt 110 I proceeded thru a green light. The traffic in front of me stopped, being backed up from the next light at NY ave, thereby trapping me in the intersection. The light turned red just before I got thru the intersection and I perceived a flash. Is this grounds for a ticket?

      Yes, you likely will receive a red light camera ticket. Stopping beyond the crosswalk is not a defense unfortunately. The law prohibits a motorist from entering an intersection against a red.

      With that said, I hope you are wrong and you do not receive a ticket.

  • Dear Traffic Lawyer:

    I was traveling northbound on Deer Park Av. (Corner of Straight Path) I was in the turning lane. In the turning lane is a red arrow pointing left.

    My car rolled slightly past the white line but did not go through the light. I could still see the light in front of me. I would say my car rolled about a cars length past the white lines but was not blocking the intersection.

    I always though DMV traffic law does not consider that to be a red light violation.

    There is a red light camera on the right side of the road on the same side as the church.

    I did not see a flash but it was broad day light so you might not notice.

    Assuming Suffolk sends me a ticket in the mail is this case defendable considering I did not go through the light?

      Dave,

      If you receive a red light ticket for this maneuver, then you likely will be found guilty. You must stop BEFORE the stop line or cross walk to avoid such a ticket.

  • My son got a red light ticket on April 1st 2011…
    NY231 Deer Pk ave@ I-495 NSR-SB. He was making a right turn after a full stop.
    If there is NOT a no turn on red is it worth fighting. He dose not think there was a sign
    or a warning of a red light camera. Thanks for your time. The photo clearly shows him
    completing the right turn.

      It’s probably not worth fighting but, if you want to be sure, tell you son to re-visit the intersection and check for signage. He should also check the website and watch the video of his “offense”.

  • Last Oct. 2010, at a Defensive Driving course [I take one every 3 yrs. for the insurance discount], the instructor told the class that when an emergency vehicle is stopped on the shoulder of the road, that you may NOT pass in the adjacent empty roadway lane, or you will get a ticket with a $700 fine!!! Obviously a police car with a dash mounted camera can record a passing car’s license plate like a red light camera can. There are new highway information signs that vaguely warn about passing a stopped emergency vehicle but they are not specific and I can’t find a complete written interpretation. Please explain. Thanks…

  • I was told by someone that his wife had made a rt. turn on a red light AFTER coming to a full stop at LIE north service road onto Commack Rd. at exit 52. A policeman tagged her for not stopping for a full 60 seconds before turning! Apparently a red light camera verified the time interval. Assuming that the story is true, is there such a traffic regulation requiring a 60 sec. stop for a red light turn? If so, when was it enacted?

      Absolutely not. The law is that all 4 wheels of your vehicle must come to a complete (i.e., dead) stop. Then you can make the right on red. Such a maneuver occurs in just a few seconds (and certainly not 60 seconds).

      By the way, failure to obey a red light is a 3-point ticket so it’s a good idea to make sure you “fully” stop.

  • I read reciently that a right turn on red requires a three second stop, anything less can get you a ticket. I checked the NY state traffic website and found nothing to confirm this is it true. Is it?

      No, the law is that all 4 wheels of your vehicle must come to a complete (i.e., dead) stop. Then you can proceed. I believe that this can occur in less than 3 seconds.

      By the way, failure to obey a stop sign is a 3-point ticket so it’s a good idea to make sure you “fully” stop.

    What about 4 way stop signs? They are the worst and they cause more accidents. I have watched people go 40-50 miles through a 4 way stop sign. I live in suffolk county and live on a dead end I also have road detectors and hazards signs on my property, but it will only be a matter of time before someone misses the turn and takes out my house. Long Island has a bunch of stupid idiots driving, young and old. Lord Hear My Prayers

    I want to know why I got a 2nd notice with a $25 fine attached for a ticket that was issued in October that I never received. And why was the address to send the ticket and fine not in New York State. Gotta love NY. Always outsourcing. I am surprised I did not have to send it to another country and pay shipping and handling.

  • Is there a way to find the names of local legislaters that voted for these cameras? The public should begin a letter writing campaign with their co-workers,labor organizations,special interest groups etc. expressing our outrage of “Big Brother”reaching into our pockets for this soley monetary based initiative in these financially difficult times, and let them know it will cost them votes from individuals as well as groups in the future. Are there at least any local jobs being created by these installations ? or are we paying out of state workers to take this money home and support their local economies? This is the beginning of a futuristic wave of mass population control , think about it where will it go from here ? perhaps the movie Demolition Man is not really far fetched !!!!

      That’s a good question but probably not necessary. A letter writing or petition campaign to your local politician should get their attention. In Arizona, public outrage over speeding ticket cameras led to their repeal. Politicians are sensitive to their constituents so an effective campaign might very spur action. Good luck!!

  • The red light cameras have been popping up all over Sunrise Highway in Suffolk County. Last week one was installed at the WB service road and Lakeland Ave. They are also on both service roads at Johnson Ave, Rte 112 and the EB service road, and just yesterday one was installed at Vets Hwy (NY454) and Broadway Ave.

    Yes, this is a big money maker for the county during tough times, but after seeing how many people run red lights here and risk innocent driver’s lives to save a minute or two, I applaud the action. Yes, there will be the rare instance where the ticket is not deserved, however if you are obeying the law, how can you be opposed to something that increases safety and generates revenue at the same time? Yes, I know the research shows an increase in rear end collision at intersections where the devices are installed, but research also shows a dramatic reduction in side impact collisions and therefore a significant reduction in fatalities. This is long overdue!!

  • They Just installed yesterday new cameras on Lakeland Ave and Sunrise Hwy in Bohemia. Also I’ve seen cameras on Rt 109 and New Hwy in North Lindenhurst. Well- maybe Suffolk Co. is going to cut taxes??? ;P

  • just passed a work crew installing camera’s at rte25 (middle country rd) and Nicolls rd center reach (seldon) in suffolk country.
    also i am a member of an organization that escorts kia service men and veterans funerals. i am sure we are going to be caught in many red light camera’s. what happens in case of multi offences. thank you

  • I was on the 495 service rd heading east on the south side of rd & RT 112 when I got a ticket for light .The lights turn from yellow to red to fast thats how they make there money they say when you go on web site they give you 4 second but they dont & also my mom got a ticket there to she 72 yrs old she doesnt go throught yellow or red & she got one she was on RT 112 & that same service rd side. Its out of control now you have no privacy any more what are we like Russia

      I no it is frustrating but these cameras are here to stay. If you see ANY yellow light, brake rather than accelerate. I can say that disobeying a red light is one of the most dangerous traffic violations in the book.

  • The person that was driving my car said she would go to court and tell them that she was driving my car . What happens in this situation, does the court then void my ticket and give her one instead? Or is the ticket still listed in my name and she pays the fine. I don’t want to bother going to court if the ticket remains my responsibility.

  • I don’t see how I can be held responsible if I wasn’t driving. Isn’t this red light ticket a moving violation? I’m not sure how the government can get away with this and you keep telling people to just pay the ticket, it’s just easier! Well before you know it all of our constitutional rights will be gone, it seems that nobody wants to take a stand on principle! Having cameras following our every move is very frightning and we as citizens need to stop this type of harassment by our government.
    I’d like to know how and when did we elect to have this type of intrusion? Did the State Assembly pass these unconstitutional laws or the county?
    What can we do as citizens to repeal such laws?
    Are the tickets that one accumulates kept in a file of some sort for future reference? I’m concerned that if I pay the ticket that it is an admission of guilt and can be used somehow possibly later on against me?
    I wasn’t driving, I plead not guilty and sent my ticket in. I was notified of a court date and feel as though my efforts were/are a waste of time because of what I read here.
    Where is it written that the registered owner is responsible? Don’t I have any way to fight this ticket? And it’s not about the $50.00 it’s the principle of the matter!

      Bad news. As the owner, you are responsible. The way that they get away with it is by not making this violation affect your driving license. It is very similar to a parking ticket. Bottom line, you will NOT win with “I wasn’t driving defense” for a red light camera ticket.

          If the car is visible on the photo/video and you own it, then you alibi is irrelevant. The owner is responsible REGARDLESS of who is driving the vehicle. I know you may not like the law, but that is what it is. Think of it like a parking ticket. The owner is always responsible for it.

  • I just got one. It was received almost two months after it happened. I was on my way to my mother’s wake, which I can prove with funeral program and rememberance card. Do they ever dismiss on compassionate grounds?

      • It wasn’t the actual burial procession. I was going out to the funeral home in Suffolk to be there before the first session of visiting to make sure all the preparations were done right. The picture times are 11:59:01 and 11:59:03.

  • today i was traveling west on jericho turnpike at 5:06 pm and at that time goin west on jericho it is 100% impossible to see what so ever because of the sun blinding u and ur visability is down to about 10% than a normal 100% i couldnt see the traffic light an slowly was still goin down jericho not realizing it was a red light i went through. Can I fight back because that is 100% not my falt i had no visability what so ever

    I know this because I saw the camera and it’s flash.
    But there was no signs what-so-ever. I took a picture of surrounding area from multiple point where camera has been placed.
    Do you think this will help me get out of ticket?

      The omission of a sign can very well help. The regulations require that a sign be posted at the intersection warning of the red light camera.

  • If I can get a reply to this question?
    I heard from a reliable source (law student) that if you are within a maximum of twenty feet of the red light or nearest corner and go through it, you are within the zone of safety and therefore, not liable for any violations.
    Can someone verify this statement. Please e-mail with an answer asap.

    Is there an authority where we can complain about the working of the red light safety contractor.Since they probably are getting commission based on collections,they are bent upon applying the fines.
    I did not get the citation but got the overdue notice.When I sent them a letter telling them that I did not get their mail,they replied that I can send them the original fine by such and such date.I immediately sent them the check for $50 which was returned to me telling that I should send the full amount of $75.When I received this letter I called them and they said they never received the check and they have never sent it back.when I told them that I have these with me and that I can prove it,they sent me the court date.
    What should I do?
    Basically they are not a normal govt department.They are contractors.
    Are they answerable to anyone?
    Any advice?

      I wish I could help here. I would just pay the $75 and call it a today. I am sure you time is worth more doing other productive things rather than trying to save $25 (especially when you are not likely to win despite your valid excuse).

  • I dont see the cameras on the list, but they are now at the following intersections on Rt 347:

    Old Town Rd
    Mark Tree Rd
    Stony Brook Rd
    Rt 25 (Middle Country Rd)

    No signs posted at any of these intersections. The only location I see on 347 where there is a sign posted is at Nicolls Rd.

  • I think I may have been nabbed by a camera last night on Rt 347 and Old Town Rd. I have to check and see if there are signs posted, but for most of the cameras out there (seems like a new one every day) I have not seen any signs posted. I feel like taking pictures today just in case I do get the ticket in the mail. How can one prove though when the signs went up? Say in the case there isnt one there now, but is in the next few days, weeks, etc?

      Great question. Take the photos and make sure they date date stamped. If you later install signs, you can take additional photos of those as well. However, your original ones will show no signs and should be sufficient.

  • I own a trucking company. I have a contract with a large company to deliver their packages. I received a Suffolk red light ticket for one of my drivers. Due to the contractual agreement the driver has been suspended for 30 days. I reviewed the video and found he went through the red light as he approached the stop line at a speed of 40mph on rt 25. The violation time was .2 seconds. Thats like a photo finish at a horse race! I spoke to a police officer at the local precinct. He said you can not see that by eye if you tried. He would not be ticketed by a human. End result is my driver wont pay rent or bills or buy food this month!

      It does not seem like your driver has a good defense for this ticket. He can fight it but they are very hard to beat.

      I would definitely try and fight your Suffolk County Red Light Camera ticket on this grounds. The applicable law states that signs must be posted. Take a bunch of photos of the intersection from various angles and give it a try.

          If you have the time, take a bunch of photos from different vantage points and fight the ticket. Argue that the law requires that signs be posted.

    Here in Texas an increasingly vast number of motorists have found there is no consequence attached to simply ignoring these civil revenue demands. What consequences might a New York vehicle owner incur from ignoring these Suffolk County demands for revenue? How ’bout an out-of-state vehicle owner? Would Suffolk County even bother to mail a revenue demand to an out-of-state vehicle owner?

      I doubt that you’ll have an issue for failing to pay a Suffolk County Red Light Camera ticket especially if you live out-of-state. It would be too much effort to collect too little money. In contrast, an in-state motorist could have his or her registration suspended which obviously has severe consequences.

      With that said, because a Suffolk red light camera ticket is only $50, I’m going to recommend just paying it to avoid any possibility of problems.

  • Doesn’t the Constitution guarantee an opportunity for a legal defense in all judicial matters? It sounds very much like traffic cameras in general are unconstitutional.

      Many of the constitutional guarantees do not apply here because a conviction is treated like a parking ticket (i.e., does not impair a person’s privilege to drive).

  • I just got out of my unit from east patchogue, my car failed to brake when it was suppose to but it did brake, the camera on 112 took a picture of my car, I wanted to know I’d there is anything I can do to prove that my vehicle actually did stop at that light.

    I have one for you guys, i got caught on 10/13/2010 service road of lie ocean ave. I got my ticket it said due date 11/17/2010 which is a wed. I didn’t get paid till friday that week. I paid it on 20 th. I just got a letter today telling me cause i was late i have to pay a $25 late fee.

      This is unfortunate. The Suffolk County Red Light Safety Program website states that “The fine for a red light camera citation is $50. Additional late fees will be assessed if the citation is not paid in accordance with established time frames.

      I wish I didn’t have to be the bearer of the bad news. In the future, if you have any reasonable defense, you can plead not guilty to “buy” some extra time to pay.

  • Today I saw a red light camera on Rte 25 (Middle Country Road) and CR83 (Patchogue-Mt Sinai Road) in Selden (Eastbound lane). I saw it flash for another driver and then I looked and saw the camera. It must be brand new.

  • On 347 and Nicholes rd there are Video cameras that are recording cars slowing down but not making a complete stop on right turn lanes.(Seperate Lane) The lanes have yeild signs not stop signs. I am being told that if the light is red (Which you cannot see after you make the turn and come up to the yeild sign) that you are required to stop. Since when are yeild signs stop signs. Is there any past precedent that can be used on this law. When was the last time a ticket was given for a failue to stop at ayeild sign when the traffic light was RED.

      You are 100% right regarding yield signs. You can only disobey one if you fail to yield the right-of-way to another vehicle. Look at Vehicle and Traffic Law 1140 to 1146. These laws set forth the elements of such an offense.

  • If someone else is driving your car and the get a ticket from one of these traffic lights, how do you fight the ticket. For example my fiancee uses my fathers car while he states in NC, how can my Dad fight the ticket so it won’t go on his lincese?

    • Kristen, the good news is that a conviction to a red light camera ticket in New York will not appear on your father’s driving record. However, the bad news is that you cannot beat this ticket based on the fact that your father was not the driver. The owner of the car remains liable even if he or she wasn’t driving. It is similar to how parking tickets work.

  • I read on Suffolk County’s website that each camera traffic light would have a sign posted about it. After getting a ticket from a light with no sign I phoned the Colorado telephone number. They told me that since there was no sign posted, I could portest the ticket. Is this true?

    • Mary, yes, the law requires that a sign warning of the red light camera be installed at the intersection. Therefore, take a bunch of photos from various angles and distances, and send that in with your not guilty letter.

      • Rather than taking a bunch of photos, doesn’t the photo of the driver passing through the intersection suffice? It would seem that the sign warning of the cameras should be clearly visible next to the light itself. Would pointing out that no warning sign exists in the photo documenting the offense be enough to shift the burden of proof (that there was a sign) away from the driver?

          The red light camera photos do not show the intersection sufficiently for a judge to conclude whether a sign was posted (or not). Therefore, it is advisable to take a few shots from different angles of the intersection in question showing that no sign is/was posted.

            All responses are written by me, Matthew Weiss, Esq. Red light camera tickets are issued to anyone who runs a red light including anyone who makes a right on red without fully stopping or who does so where signs prohibit it. The Suffolk County red light program does require that signs be posted at red light camera intersections warning about the presence of the cameras. I therefore believe a motorist can challenge a ticket if no signs are present.

            I hope this clarifies any ambiguity.

  • Hi, What is the timing for the yellow light? I counted between 4 and 5 seconds when light changed from green to yellow to red. There is no way to stop if you are going 50 and are close to the traffic light. To me this is a set up to catch as many people as they can. I almost wish to come to red light so I don’t have to worry about getting a ticket or being hit from behind. Is it legal to allow only few seconds to clear the intersection?

  • Fight back! I just got a ticket on Ronkonkoma Ave and the North Service Road for not making a complete stop when turning right on red!! Buy Photoblocker spray. It’s not a scam, it’s works and some states have already banned it.

    • The spray does not work as suffolk county takes a video. They use the video to zoom in and get your plate after the spray reflects the flash. They do offer a plastic plate cover that distorts your plate when viewed at any other angle than 0 degrees. i learned the hard way and spoke to the company who suggested the prism cover.

      By the way does suffolk county have to post signs approaching the red light camera for it to be legal? If so what is the law #

        Thanks for this info. The spray is illegal but I’m sure readers will appreciate to learn that it doesn’t work.

        I’ll have to research whether the law mandates a sign but, for now, the official website states:

        “The purpose of the red light camera program is to improve intersection safety by reducing the number of red light violations. If the warning signs stop motorists from running red lights rather than the cameras themselves, then the purpose of the program is being met.”

  • Hi traffick Lawyer, I believe I just got a ticket over by the ramp by 110 or 109 i forget which one is which over by southern state in farmingdale. It was during this torrential rain and I was going to fast to stop for the yellow and as I got into the intersection it turned red and I saw it flash, although I tryed to stop before, I skidded half-way through and got nervous and sped through during the yellow. Is there anyway that I can fight this? thanks Tom.

    I was coming down from 454 eastbound but was entering the right lane by mistake onto motor parkway but turned out back onto 454 eastbound and suddenly a light flashed. The light going 454 eastbound was still fully green (not even about to turn yellow). Did I just get a ticket?

      I doubt it. Camera tickets in Suffolk are only being issued to drivers that disobey certain red lights at certain intersections. From your above description, it does not sound like you committed such an offense. Of course, if you did, you’ll know if a few weeks when you receive a “love letter” in the mail.

  • Do you know who Suffolk County contracted with to install, maintain red light cameras and issue citations? I would love to know who the contractor is. I think they are in Colorado. Thanks.

      • Marilyn, you are apparently write. Violators are instructed to remit payment via mail to the Suffolk County Red Light Safety Program at PO Box 1730, Denver, CO 80201-1730. They do not provide any more info for the company, however, in the Notice of Liability. Perhaps, the customer service number at 866-637-0008 can provide you with the company’s name and physical address. I hope this helps.

            Give it a shot. Take a bunch of photos from various vantages points and argue that there is not sign advising of the red light camera from this direction of travel.

  • This is really bad. I have already got two tickets – one is for turn RIGHT without stop on red light. So any chance we can fight back ?

      There very few defenses which will work.

      Here is the list: Unexpected mechanical failure in car; your car was used by someone who stole it from you, unexpected medical condition, medical emergency, and broken traffic signal.

      • I recently received a red light ticket but was curious if weather could be a reason for the infraction. It had been raining out and I found it safer to continue through the intersection rather than stop quickly at 55mph. The red light time was .4 seconds… Your thoughts?

  • Oh I’m sure other counties in NYS will follow suit like Westchester County and perhaps Rockland. They’re strapped for cash and are contemplating this idea. I absolutely hate when suburbs attempt to copy the same blatant revenue generating robbery tactics of urban cities. What’s the point of moving out of NYC then if you’re subjected to the same stupidity on suburban roads where they will shorten the yellow light duration to create situations in which motorists think they can make the yellow, but get caught with the cam as the light changes to red midway through the intersection as it does in NYC? This stupidity is only getting worst.

      Each camera generates $2 to $3 million a year. This kind of revenue is hard for cash-strapped municipalities to ignore. Unless local government cut spending and practice more fiscally conservative policies, these types of programs will continue to proliferate.

      There was no sign posted that this was a red light camera intersection, and the website states that all intersections are supposed to have signage indicating as such. Is there a chance that I can refute the ticket?

        • I (and/or my wife) have gotten tickets for making a right turn at a red light. It is OK to make a right on red in Suffolk — as long as it is safe and there is no signage saying you can not do so. While I seen signs posted that there is no right turn on red — some intersections do not have signs. Recently they are starting to impose tickets for making right on red at these none-posted intersection as well. Is this legal? For example, corner at the intersection of Commack Road and the LIE (495 EAST) in Commack, Long Island. There is no signage — yet she has gotten “camera tickets” for making a right when the traffic flow allows it.

            You can make a right on red in Suffolk County unless there is a sign prohibiting such a turn. The red light camera tickets are being issued to those motorist who make that turn illegally. Specifically, motorists must come to a complete stop prior to making the right turn. A slow or rolling stop before making a right on red is illegal in New York.

          • I just got a ticket from this same intersection. Commack Road North and the LIE. There is no sign there. Why would I have gotten a ticket from the camera? Can I fight it?

            I don’t know if you have grounds to fight this ticket from your description. I can say that beating a red light camera ticket is near impossible.
