In March, we wrote about a unicyclist who beat a traffic ticket for riding it on a NYC sidewalk. His traffic lawyer was able to successfully argue that the law in question did not cover one-wheeled devices (only 2- and 3-wheeled bicycles).
Last week, Kyle Peterson, the unicyclist, was not as lucky. Peterson’s $3 million lawsuit arising out of the wrongly-issued ticket was dismissed. The Federal court judge acknowledged that the issuing police officer made an error but held that this mistake did not rise to the level of unconstitutional discrimination.
Without a huge payday from the lawsuit, it looks like Mr. Peterson’s days of cycling and juggling won’t be ending soon. A win for NYC residents.
