How Much Is A Speeding Ticket In NY?

We are often asked the question: “How Much is a Speeding ticket in NY?”.  The literal answer for a first conviction is that a New York state speeding fine costs between $45 and $600. For speeding 1 to 10 mph over the limit the range is $45 to $150.  For speeding 11 mph to 30 mph, the range is $90 to $300.  Finally, for speeding 31 mph or more, the range is $180 to $600.  For a second speeding conviction, the maximum fine can be increased by up to $150 and for a third, it can be increased by up to $375.

Of course, these ranges of fines do not include the $88-$93 additional New York State speeding fine surcharged imposed on all moving violations.  Additionally, it does not include the Driver Assessment Fee that is imposed on motorists who accumulate 6 or more points on their licenses.  This fee is $300 for 6 points and $75 for every point above 6.

However, there are many other NY speeding ticket costs.  For example, it is not widely known (or enforced) but a judge can also impose up to 15 days in jail for a speeding 1 to 10 mph speeding ticket, and up to 30 days for 11+ mph speeding ticket.

New York Speeding Ticket Fines and Points

On the other hand, most of you know that speeding tickets result in points being added to your driver license.  In the state of New York, a speeding ticket carries a total of 3 to 11 points.  Below is an overview of NY speeding ticket points:

Speeding 1 to 10 MPH: 3 points

Speeding 11 to 20 MPH: 4 points

Speeding 21 to 30 MPH: 6 points

Speeding 31 to 40 MPH: 8 points

Speeding 41+ MPH: 11 points

 

Beyond the points, another speeding ticket cost is that it can result in a license suspension or revocation.  Some judges will suspend a motorist for just one 8-point or 11-point speeding ticket conviction.  Some will suspend for two speeding convictions.  The DMV can suspend your license if you accumulate 11 or more points within 18 months (from speeding convictions or otherwise).  Finally, three speeding convictions within 18 months will result in an automatic and mandatory 6-month revocation of driver’s license.

Another cost of a speeding ticket conviction involves your automobile insurance rates.  By law, a New York insurance company cannot raise your rates for one speeding conviction of 15 mph above the limit (or less) if you have an otherwise clean record.  For a higher speeding ticket or multiple convictions, however, your auto insurance rates can be hiked.  The only option to address a hike is to take the Driver Safety Class that takes 10% off your insurance rates.

  • Hello. I just got my first speeding ticket going 71 in a 55 zone on the 290 in Amherst, NY. I was driving from Villa Maria College to my workplace on Grand Island where I live and I was very late. As I started slowing down, the trooper had already put his sirens on. How much is my ticket going to cost? How should I plea? If I go in person to pay for my ticket, is it possible the fine will be reduced to a parking ticket?

  • Hello. I recently got pulled over for doing 89mph in a 45mph highway limit zone. This is my first speeding ticket and my record has already 2 points for a minor offense which consisted of operating on a bicycle lane. I believe if I plead guilty, my license will be suspended + a hefty fine. Will pleading not guilty somehow possibly diminish the penalty or will the judge just laugh in my face?

  • My daughter was traveling on State Highway 17 west bound heading back to Ithaca College when she was pulled over. She was pulled over for speeding (80 miles in a 55 miles speed limit). My daughter has a NJ Driver license and never receive any tickets. Should we contest this or plead guilty? What will this do to her record if she pleads guilty? How much would this cost?

    This happened in the town of Hancock, New York (Delaware county). Don’t know if we can afford an attorney or if we would need one.

      I recommend that you she plead not guilty. If she does, she likely can save points in NY (and possibly NJ) as well as sea the $300 Driver Assessment Fee.

  • Hi. I was caught going 83 in a 55mph posted zone in Long Island. I have a MA drivers license and wanted to know the potential fines and if this ticket would make its way over to my MA license. I have two prior speeding convictions but nothing as high as this last ticket.

      The fine for this speeding ticket will be roughly $200 but you will also be billed $300 for the NYS Driver Assessment Fee. Also, a NY conviction will transfer onto your MA license. If you plead not guilty, you likely can save the $300 fee and minimize the impact on your MA license.

    Few questions – I recently received a ticket on Rt 87. The ticket is for 83 in a 65. Will I be looking at that $300 Driver Assessment fee? or just a ticket around $200?
    I plan to plead guilty most likely as it would be a haul for me to drive back up there. I have an MA license and insurance how will these be affected? I have 1 prior ticket I got in RI about 2 years ago for 5 mph over.

      No assessment fee for this ticket because it only carries 4 points (assuming you have no other current points).

      A NY speeding conviction will transfer onto your MA license. Therefore, you may want to fight this ticket. If you cannot go, you can hire a NY traffic lawyer to appear for you.

I was going to Canada and NY state trooper pull me over and gave me 2points uniform violation. Even though I was rushing little bit to take my kids to the bathroom, they woke up from sleep and started crying to go to the bathroom, I was driving 70 mph in 65mph driving zone! What shall I do now? The ticket said Disobeyed traffic control device, The court is 5 hours or 300 miles away where I live. he told me that he didn’t give me ticket for speeding and did me a favor. I don’t mind pay the fine to the State, but can’t effort to get points. This is my first time I ever had points on my license. What is the right thing to do? oh by the way cop said I was driving 81-82 miles per hour and I know for a fact it can be more than 70 because I don’t speed and my car was on cruise control 70 miles.

      Because the officer already gave you a break, you live so far away from the court, you have a PA license and a 2-point ticket is not very serious, I recommend that you pay it.

  • I was driving in Salamanca NY today wasn’t watching the speed limit. The speed limit went from 45 to 30 and the cops pulled me. I am from PA. I am not familiar with the way things work in NY The officer said I wouldn’t get any points on my PA driver license but it would effect my NY driving record? Which i am confused about? Why wasn’t their a fine amount on the ticket? Since I am not rich does NY offer payment plan options? What should i do?

      Which i am confused about? You have a PA license and record, but NY will keep a separate record for NY convictions. So essentially you have two records.

      Why wasn’t their a fine amount on the ticket? The fine will be assessed by the judge. It will be roughly $200.

      Since I am not rich does NY offer payment plan options? No but the court may give you time to pay whatever fine is imposed.

      What should i do? Plead not guilty and fight it. This way you can reduce the number of NY points assessed on your NY record. If you don’t drive in NY often, however, then you may want to just pay this one. Check with your PA insurance company first to see if this NY ticket will adversely affect your rates.

  • I was driving on 684 today and was pulled over by a state trooper who gave me a ticket for allegedly going 90 in a 65 and for following too close to the vehicle in front of me.       Definitely plead not guilty to both. These tickets carry 6 and 4 points respectively, roughly $200 fines each plus potentially a $600 Driver Assessment Fee. By pleading not guilty, you will have an opportunity to negotiate a plea bargain to save money and points.

      A 70/65 speeding ticket carries 3 points, not 2. Assuming the officer did not give you a break at the time of your stop (i.e., reduce the speeding amount or points), then you should plead not guilty and, on your court date, speak to the prosecutor about a plea bargain. If you’ve already been given a break, then you may not want to challenge it further because the court could reinstate the original charge.

  • Hi my daughter was coming home about 8.30 at night on Nov9th 2013 driving the thruway wasn’t a lot of traffic on road she was driving in the left lane with a car in front of her but no one else around seen a troop pull up to the u turn my daughter then moved over to right lane he followed her for several miles then pulled her over he asked her do you know why I pulled you over she said I wasn’t speeding and he went to his car and came back and gave her two tickets one for failure to stay in right lane and a ticket for obstruction of her rearview mirror she had a chain with a small cross on it . What are the points for this and fines and would it be cheaper to get attorney . I just feel that this guy was just looking for a reason to pull someone over

      The Failure to stay right is a 3-point ticket. The obstructed rear view window does not carry any points, however. The fine are roughly $150 each. We recommend that you plead not guilty to both. If you do, you likely can negotiate this down to save points and possibly fine money.

    I was caught doing 98 in a 65 on i684 near mount kisco. He reduced it to 66 in a 65. Should I plead guilty ? What would be my fine and do I receive points?

      A 66/65 only carries 3 points and roughly a $200 fine. Since the officer already reduced your charge, it’s not likely that you’ll get a further reduction. It is possible (but it is also possible that the court could amend it back to the original charge).

      Tough call but, if you’re otherwise, clean perhaps you shouldn’t fight it.

  • Afternoon Mr Weiss. I received a speeding ticket 87 in a 65 mph zone in Steuben county. A offer was given to bring it down to 70 in a 65. I have a Florida license. How will this impact my Florida license while I’m in New York? Also approximately how much do you think I will have to pay? 1st and only ticket ever in my 36 years.

      The fine for this ticket is roughly $200. New York will keep track of convictions that are imposed against you with your FL license and New York will penalize you for these convictions in the same way a NY driver would be penalized.

    I was driving up to Amenia from NYC late last night. I was driving the car because my girlfriend was tired, she drove down to NYC earlier that day. I’m from Holland and I do not have a NY driver license. I do have a Dutch driver license but I did not had it on me.

    I got pulled over for speeding, 79 mph in a 55 mph area and the officer gave me a ticket for unlicensed operator. Do I need to plea guilty / not guilty and try to fight it in court?

    I recently got a speeding ticket, I was clocked at 92 in a 65. This occurred on state route 17 on my way back to NYC from Ithaca. The car was not mine, this is my first ticket and was wondering 1. What is a rough estimate of the cost of the ticket? 2. If I plead not guilty would I have to go to court in the county I recieved the ticket? I do not live there and cannot possibly travel there as I do not own a car.

      If you plead guilty, you will be assessed 8 points and roughly $300 in fines. Plus, you’ll owe a $450 Driver Assessment Fee and your insurance rates can be increased. We therefore recommend that you plead not guilty. If you cannot return to the county where the ticket was issued, then you can retain a NY traffic lawyer to appear for you.

    I was on I87 in Plattekill and got a speeding ticket for going to 80mph in a 65 zone. I got a NJ license. What penalty do I get when I choose to plea guilty and will my insurance rate increases?

    The ticket said 1180B and 1180D. What do they mean and does having both of them increase the penalty?

    I also got a speeding ticket in January 2011 for going to 70 in a 55 zone by a camera, but I was not the driver at that time. Does this ticket still count and that the one I am having now on I87 is already the second ticket? That means I do not have a clean record to start with? Will my insurance rate increase if this is the second ticket?

    Is it better to plea not guilty?

      A conviction to this offense will give you 4 points in NY and 2 in NJ.

      In regard to the prior camera speeding ticket. Where did you get it? NY? This affects my response.

    While searching for some info on speeding tickets, I came across your page and decided to post. I got my first speeding ticket this morning on the I-490 in Monroe County, NY. While hearing what the officer was telling me, at that time, I wasn’t really comprehending… but I swear he told me to plead not guilty, that I’d have to go to court, and that the fine will get reduced. Is this correct? Do i have to mail in my plea, or just show up on the date/time that’s on the ticket? Thanks.

    I’m a tourist on visitor visa from INDIA. I don’t have NY or any other State drivers license but I have International driver’s licence issued from my country, which is in English.
    I got speeding ticket on route I90 (VAN BUREN TOWN OF-3468, ONONDAGA county) Baldwinsville, New York. I was charged Section 1180D for speeding up to 80 mph on a 65 mph road on way to Niagara on 23rd Aug.
    Since as a tourist(visitor visa) this is my first such experience and first visit, I don’t have any idea what I should do. I would really appreciate if you can guide me. I have questions like should I plead guilty ? how much I would be charged total in my case, since the charges you explained are tough for me to pay, How should i go about it to close out my case positively ? currently i am staying in MA and my visit is till end of this September.

    Just to close out my case, I received a response from the court. The town justice accepted my plea and assessed a $150 fine plus a mandatory surcharge of $93.
    I figure I am paying $243 toward the upkeep of Mooers NY for an offence I did not commit but thanks to your advice I feel I came out of it far better than I otherwise would have.

    I got a speeding ticket in June driving at 80mph at 55mph zone at Suffolk county with a CT license. I moved to NY in July and obtained a NY license. I was invited for a conference at Suffolk County TPVA. Please, what might be the total fees I can incur if I plead guilty or not guilty? Also, will points be added to my NY licence since I now reside in Long Island NY and have a NY licence? Or will they go by the CT license? Also, do you think it will be a good idea to get a lawyer?

      This speeding ticket carries 6 points and roughly a $400 fine. It also subjects you to a $300 Driver Assessment Fee. You definitely want to plead not guilty. If you do, you likely can save points and the $300 Driver Assessment Fee. Because you have a NY license, CT DMV is not involved here.

      You may want to retain an experienced NY traffic lawyer as 6 points is potentially a lot to get for one ticket.

    After hours of reading your excellent blog, i am venturing out and posting.

    I am from Ottawa, Ontario, Canada. I was just in upstate new york and i was driving on highway 37 (St Lawrence County). During a long stretch of road, i went to pass a car, coming in the opposite direction was a state trooper (2 of them in the SUV). They passed me and I saw them turn around in my rear view mirror. A bout a mile or so later, through a 45 zone followed by a 35 zone, i was pulled over (there was a car between us that pulled over as the result of the tropper’s lights).

    The Troopers said i was going 72 (but 73 on the ticket) in a 55. They gave me a ticket for going 70 in a 55.

    Should i fight this ticket? Is there a change it will get bumped back up to 73? 15 over to 18 over?

If you do, you likely can negotiate this charge down to a less serious charge saving NY points and Ontario demerit points.

      BTW, i wouldn’t worry about a “bump up” to 73 because a 73/55 is 4 NY points and 3 Ontario demerit pints (just like a 70/55).

    I received a speeding ticket in Harrison town in Westchester County last week. The officer used a radar and determined I was going 60 MPH in a 40MPH zone. The ticket says I was in violation of NYS V & T Law, section 1180D.

    I currently hold a Maryland license. I received a speeding ticket in Delaware in 2009, and a speeding ticket in North Carolina last year (although that ticket was reduced to a non-moving vehicle violation).

    What would be my best course of action? Should I plead guilty? Or by fighting the charge, how likely is it that I could receive a lesser sanction?

Now I currently moved to New York 3 weeks ago and do not have a NY license (using Connecticut license) but just registered my car in New York and purchased insurance on it one week ago.       If you plead guilty, the court will impose roughly a $200 fine and assess your CT privilege to drive in NY with 4 points. These points will NOT transfer to CT but the conviction will be reported to CT.

  • I just got a Failure to stop at a steady red arrow citation in NY near Buffalo. I have a Pennsylvania drivers license. Violation is 1111D3. If I plead guilty, what is the likely fine and points?       If your case is returnable at the Buffalo Traffic Violations Bureau, then I recommend that you just pay this ticket (given your clean record). They do not plea bargain at this court and points from NY do not transfer.

      Even outside of the Buffalo TVB system, you may want to just pay given your clean record and the fact that points do not transfer to PA.

      A NY conviction will be reported to PA and can be used by your insurance company against you but, again, given your good record, this shouldn’t alone be enough to affect your rates.

    My 19 yo son just got a ticket (1180d) for doing 81 in a 65 mph zone on I87 in Plattekill. He pled not guilty and plans to show up. 1. Can we plea bargain here? 2. Do NY points transfer to Pennsylvania? 3. In October 2010 he got a 2 point ticket in NJ when we were living there. Do those points transfer to PA and if so, have they dropped off? Thank you!

  • I received a speeding ticket for 71 in a 55 on the Taconic Parkway in NY. I plead not guilty and the special prosecutor offered a 2 point “failure to obey a traffic control device” with a $180 fine in exchange for a guilty plea. I took the deal. Do you know if the 2 points will show up on my CT license or affect my insurance rates (otherwise clean record)? Thanks,

      Points from a NY conviction will NOT transfer onto your CT license. The conviction will be reported to CT and, therefore, could impact your insurance. However, given your clean record, I seriously doubt that your rates will increase from this one NY conviction.

  • I wrote here at the end of June concerning the ticket I received for the 1113A infraction. Thanks to your good advice I plead not guilty and requested the officer’s supporting deposition.I never received the supporting deposition but did receive a letter from the court advising that I could contact the DA and request a plea bargain.
    I provided my statement and the supporting documentation they requested. About a week later I received an email from the DA’s office which said “Please see attached. Print out and return to the court listed.”

    The document says:

    Original charges:
    VTL 1113A
    UTT 1B350CD2SP
    Points: 3

    Plea:
    VTL 1175a
    Points: 2

    It also specifies:
    No prior history on abstract
    Ontario license
    Fine and Surcharge set by court

    And they gave me 20 days to respond.

    Any thoughts on what I should do with this? Not sure what a VTL 1175a is. How would this transfer to Ontario?

      Thanks for reporting back and glad to hear my advice was so helpful.

      A VTL 1175 ticket is a 2 point ticket in NY for “blocking the box” or obstructing an intersection. I believe Ontario does not have such a charge (please check this) and, if so, you should accept the plea offer as it will not transfer as demerit points onto your Ontario license.

    I have a license in MA. I got a speeding ticket in the I90 in Erie County, NY for going 85 mph in a 65 zone. I just plead no guilty, but it is too far to go there for pre-trial conference and trial court later. I have a clean driving record. Any suggestions? Thank you!

  • Hi, You mention to not plead guilty in some of these. If were to plead not guilty for my ticket what would happen? I know I would have to go to court, but should i come with a lawyer or should I go by myself. How do you negotiate to a less serious charge? My son received a speeding ticket 30 miles over the limit and this is his first ticket. I’ve never had to do this before and don’t know how to go about it.

  • I got a ticket doing 87 in 65 in Rensselaer County. My cruise control was at 74 and I sincerely believe the trooper pulled over the wrong vehicle. He did not agree with this. What will this ticket cost, how many points, and is it worth fighting for. This is my first speeding ticket.

      An 87/65 carries 6 points, a $300 Driver Assessment Fee and roughly a $200 fine. It can also adversely affect your auto insurance rates. You should therefore fight it, or retain a NY traffic lawyer to handle it for you. If you do, you likely can save points and money.

    I got a speeding ticket for going 73 in 40 MPH zone in Seven Lake road (Sebago Lake)
    I was watching fuel economy display instead of speedometer on uphill
    I explain this situation to officer and he only write in ticket “unreasonable speed prudent”
    This is my first ticket during 11 years
    What should I do, plea guilty or fight for it?

      An “unreasonable speed prudent” ticket carries 3 points. We, therefore, recommend that you plead not guilty. If you do, you likely can negotiate this down to a less serious charge.

    I got a license from Indiana and was given ticket going 82 in 65mph zone on I-90 WB. I was thinking of going with Chautauqua county District Attorney’s Traffic ticket plea policy. The “written charge” to me is 1180d and the “plea of guilty to” is 1200d,
    Whould you tell me what would be the fine to be paid and points will be assessed for this ticket if I do not have any points right now. Should I plea my guilty? Should I plea of guilty (section A of the ticket) and place “X” through section B, or plea of not guilty (section B) and place “X” through section A.

      Plead guilty to the reduced charge of 1200d. This is a parking ticket that carries 0 points and will not transfer as points onto your Indiana license.

      This is a great result off your original speeding ticket charge.

    We are from Canada. Last week we were stopped in route 82 (Livingston), a one lane road, supposedly for unsafe overtaking which we reject (dotted line for 600m on a 900m straight, no cars coming), and we returned to the right lane safely after passing still under dotted lane and by then another car approached but, under NY laws it was far enough (more than 200ft or 60m).
    The second ticket was speeding at 70MPH in a 55MPH zone (the driver was looking forward while passing not the dashboard but I still have my reserves).
    The officer didn’t say how much it would cost, and we don’t know if it’s worth fighting it (compared to hiring a lawyer or traveling there), or if it would represent points to the license here in Canada.

    We would like to have an insight of the situation

      Because points from New York transfer to Ontario and Quebec, we recommend that you fight these tickets (assuming you are from one of these two provinces). You are looking at around $150 to $200 for each ticket in fines plus a $375 Driver Assessment Fee. We therefore recommend that you plead not guilty and fight these tickets. If you do, you likely can save money and demerit points. If you do not want to travel back to New York, then you can retain a NY traffic lawyer to appear for you.
