Nassau County Red Light Cameras & Red Light Camera Tickets

Below is a list of intersections where Nassau County red light camera’s will be installed.  If you pass a red light, you will receive the ticket in the mail.  This ticket carries 0 points and will not affect your auto insurance.  It is more akin to a parking ticket. We do not recommend fighting this type of ticket unless the photographs of your car do not show you running a red light, your car was stolen at the time the violation occurred or you experienced mechanical problems preventing you from obeying the red light.

Of course, if you receive a red light ticket from a police officer in Nassau County, this is still a moving violation .  We recommend fighting this type of ticket as it carries 3 points and could affect your auto insurance rates.

By the way, Nassau County will do NOT expect Nassau County to install warning signage like the one depicted below.  Rather, like New York City, it is expected to install the inconspicuous cameras without warning in order to maximize the number of motorists caught breaking the lights and, thereby, maximize its red light camera revenue.  Watch out, Big Brother is watching you!

There are also rampant rumors on the internet that motorists running a yellow light will also be issued such a ticket but that makes no sense.  It is not illegal to run a yellow light in New York State, only a red one.  As long as you enter the intersection (i.e., pass the cross walk prior to the light changing from yellow to red), you have a strong defense to any yellow light ticket.

    Hi Mr Weiss,

I got pulled over for a headlight being out. I did what I was supposed to do and got it fixed by sundown the next day and got a nassau country cop to check and sign off it was fixed. I bought in the proof to the garden city clerks on Axin Ave and waited a while . When I finally got to the clerk he wouldnt even look at my new ticket and proof because I have an old ticket that went to collections. They kept pressuring to for to pay it before they would even look at and dimiss my new one.

How is this ok? What if I had just mailed it in instead of showing up since it didnt recquire me to show up.?

Sorry to hear. What did you do? Pay the old ticket? If so, did they let you address the headlight ticket?

  • Hi. I received a ticket for No Turn on Red except from right lane. I did not come to a full stop. However, there are two points I would like to make: a) One street further up has written by a similar intersection “stop here on red”. The sign is making a point that says stop here on red. Can an argument be made as to why a sign like that has to be placed only there (it’s kind of saying let’s make a point to tell people because they don’t know) So put the sign everywhere. b) If the No Turn on Red except from right lane was partially blocked by another sign, does not warrant dismissal? On a separate note I was driving 12 mph, there were no pedestrians and I have a clean driving record.

      Joey,

Neither point is unpersuasive. The lack of a “stop here on red” sign does not permit you to make an illegal right on red. And the partially obscured sign will not help you as you admittedly failed to come to a complete stop before making your right on red.

  • I got a red light ticket. The sign says “No Right On Red Except From The Right Lane”. I was in the right lane. There was no sign saying to come to a full stop first. I assumed, apparently incorrectly, that if you were in the right lane, you didn’t need to come to a full stop. It’s clear from the video and photos that there was no cross traffic in front of me at the time. What do you think? Should I fight it?

      Brian Finley,

It sounds like this ticket was issued via camera. If so, you may want to just pay it. Camera tickets carry 0 points and do not affect your auto insurance rates.

Further, you must always completely stop before making a right on red.

I turned right on red but there was no camera behind me or on the turning signal. it is just on the other side of the intersection. So i was assuming it only gets you if you are coming from that side. Please advise!

I believe it varies. If and when you receive the ticket in the mail, you can see the photos and from where they were taken.

  • I received a ticket at WB marcus ave @ lakeville rd, for not stopping at a red light. I’m from brooklyn, and so I am not familiar with the rules in this area UNLESS if there are stop signs and no-turn on red signs- Marcus @ lakeville does not have either, all they have a is a “photo enforced” sign, with no other signs (besides the signage for the HWY). How is one to know that there are no rights allowed on red if there is no oncoming traffic. I slowed down and came to a rolling stop, and proceeded because this was at 10pm on a Saturday, and not a soul was around me. Should I bother mailing in the “coupon” to request an appearance regarding this? The ticket is for a whopping $150, which seems unusually high, especially at trying times like this.

    • Keep in mind, it’s not even a “red light photo enforced sign,” just a “photo enforced” sign with nothing else highlighted but a signal.

It is illegal to make a right on red in New York (except NYC where right on red turns are generally illegal) unless you first come to a complete stop.

There is no sign prohibiting a right on Red. There is no Red Light Photo enforced sign. Two other cars ahead of me made the same right turn without stopping on the Red light and I was the only car that was flashed. Do I have any legal right?

I am going to do the leg work on pursuing eliminating right turn on red tickets or at the very least reducing the fee being charged. I have done a great deal of research and believe I can make a good case. If you are interested in adding your signature to what I plan on doing, I will do all the writing and follow up. I just want to approach this from a position of as much strength as possible. I do hope this reaches you, although I know I am on Weiss’s website.

  • Got a camera ticket for making a right turn at a red light, which is legal in Nassau and no “No right on red” sign was posted. It seems the light also had a right green arrow option but this was not lit at the time. Just a red light and 4 dark signal circles underneath. No other signs. How would anyone know to wait for an arrow? This happened at Peninsula blvd and Rockaway Tpke. Are they right?

Question with ring road south and making a RT onto Stewart Ave. There is no sign stating “no turn on red”. Would the ticket be given only if the car did not stop for three seconds? any turn faster then that would be fair game for ticket? Thats the only reason I can think of for receiving the ticket

Hi My wife was headed west on Hempstead Turnpike in the left turning lane turning left onto Nassau Blvd headed south with a green arrow for her, the green arrow turns yellow for 2 seconds then to a green light. while she passed under it never RED . We received a red light ticket. How is That legal. The film clip supports everything I said. I even went back and filmed the same. I would love to show it to you. She already paid the fine. There must be a lot of people in the same boat.

Because your wife already paid the ticket, I don’t think there is much you can do about it. You can try and appeal but it maybe too late and, even if not, appeals can be a time-consuming process.

      Rose,

You cannot get a ticket for illegally using an electronic device via camera. Only a police officer can issue such a ticket.

With that said, you should not be touching, looking, swiping, etc your phone while behind the wheel.

  • I would like to know the distance a red light camera has to be posted from the actual turn. If im not on the road long enough to see an actual sign how should i know its a red light camera corner?
I had two recent tickets that on both corners there are no actual sign posted on the light itself or at the corner. Im feeling this is not legal to know one would have to assume its a red light corner when most turns in Nassau and Suffolk County you can turn turn on red.
I would like to challenge Nassau County to put in effect all red light camera turns must have a sign posted at the light itself. This feels like a form of entrapment for the county to get more tax payer dollars at an unfair expense.
    Thank you for your time

I received a red light ticket by Glen Cove Road Old Country Road and there were two signs that I find very confusing one said must turn right and the other said No turn On Red so why do they have both signs up? I already know I am turning right I am in the turning lane.

    • Cynthia McAllister,

It seems like these signs are not very relevant for purposes of your red light camera ticket. Did you come to a complete stop (or not). If not, then you violated the red light law.

    • John Sweet,

Interesting question. Since you apparently turned on a green arrow, you shouldn’t have gotten a ticket. Red light camera tickets are only given to those that run red lights and you apparently had a green arrow (even though you turned from the wrong lane). If you do get a ticket, then I would argue that you did not disobey a red light given the green arrow and your turn in obeisance of that green arrow.

Thanks for your quick response. In the first photo my car has crossed the white line with the Red at 000.2 seconds so I have already entered the intersection. Is there any discretion for making a right turn on yellow the moment before it turns red or does the court usually deem it a violation? If there is no discretion usually shown I will just pay it I suppose rather than driving out to Hempstead. Thanks again for your advice.

  • Matthew,

    Matthew,

I was driving on Marcus Avenue and making a right onto to Lakeville Road. There is a dedicated two lane right turn and I was on the far right lane. This turn has its own light. There was no oncoming traffic as I approached the intersection. Looking at the video as I was approaching the turn the light turned yellow and as I crossed the white line it turned red. I no longer live in Nassau County so the cameras came as surprise to me. The site states:

A Notice of Liability for a Red Light Camera Violation is issued when your vehicle fails to stop at a clearly marked stop line or at any other stopping point described in the ordinance when facing a steady circular red signal. You will also be issued a Notice of Liability for a Red Light Camera Violation if you do not come to a complete stop before making a right turn.

As I was not facing a steady circular red signal until I was already into the intersection is this a basis for fighting this ticket? I live in Brooklyn so I can drive out to deal with it but just on principle it seems a 80 dollar fine for making a right turn on a yellow light with no opposing traffic is ridiculous. Any insights would be appreciated.

    Thanks in advance.

    Colin

PS Just a follow up the first photo shows my car has entered the intersection with red at 000.2 seconds at 15 mph and the second photo has me driving on Lakeville with Red at 1.6 seconds at 15 mph.

  • I recently received a ticket via Camera in Nassau County at NB Quentin Roosevelt Blvd making a right onto Stewart Ave. I watched the video and I noticed in fact I did make my stop (although brief) but it was AFTER the white line by about, but 5-6 feet and right at the beginning of the cross-walk. Is this cause for a ticket? Or should I fight this? It’s a joke because the white line is so far back, you can’t safely assess oncoming traffic from that white line. Do they want you to make a useless false stop at the white line, then inch ahead?

Also, I do not remember there being a sign indicating a Red Light Camera. I thought legally they had to post that notice?? Is that not true?

    Thanks for your insights

    • Steve,

The law requires that you make a full stop before the crosswalk, stop line or building line. If you made a complete stop (all four wheels ceased moving), then you could argue that you stop within the vicinity of the stop line. I’m not sure that this will be successful but you can try.

No red light camera signs required for the People to uphold a case.

  • Just curious – how can Nassau issue the $30 “Driver Responsibility Fee”? Doesn’t it violate the New York State Vehicle and Traffic Law Section 1111-e below (specifically the last sentence):

    (e) An owner liable for a violation of subdivision (d) of section eleven hundred eleven of this article pursuant to a local law or ordinance adopted pursuant to this section shall be liable for monetary penalties in accordance with a schedule of fines and penalties to be set forth in such local law or ordinance, except that if such city by local law has authorized the adjudication of such owner liability by a parking violations bureau, such schedule shall be promulgated by such bureau. The liability of the owner pursuant to this section shall not exceed fifty dollars for each violation; provided, however, that such local law or ordinance may provide for an additional penalty not in excess of twenty-five dollars for each violation for the failure to respond to a notice of liability within the prescribed time period.

At the moment, traffic signal on Merchants only allowed left turn from Merchants to Stewart EB or right turn to Stewart WB. I stopped for 2 seconds, I know it is a bit shorter than a 3-sec stop, but all traffic going Merchants northbound were blocked (due to the left turn green light on Merchants), and it was safe for me to turn right. I even believe, as at many other intersections, it should give right turn only light on Stewart WB. Based on your experience, do you think I have a chance to fight the ticket? thanks!
