The Easiest Way To Fight A NYC Parking Ticket

My dear friend Lawrence Berezin of New York Parking Ticket.com has graciously shared his user-friendly way to identify defects in a New York City parking ticket. The below image show the 10 items which must be properly completed in order for your NYC parking ticket to be valid. If any one (or more) of these items are omitted or incorrect, you should plead not guilty to the ticket and explain which of these items are defective.

  • Hi. Thank you for all your advice! I received a double parking ticket in the mail that supposedly happened over a month ago. I wanted to know if any of these missing information can be used to defend myself….. The Exp. Date box says “N/S-Rain”. The MAKE and YEAR box both say “N/S”. Are any of these required? Also the officer commented that “refused to move when asked” which isn’t true because nobody asked me to do anything. But where the officer signed it says “if the operator was present I indicated the operator’s name or indicated ID refused and personally served this Notice”. If the officer asked me to move are they required to ask for my ID or right ID refused before issuing me a ticket? Are there any reasons my double parking ticket should be dismissed? Thanks again for all your help!

    I just got 4 Parking Violation notices from Nassau County, NY for 4 tickets (no front plate, no rear plate, uninspected, unregistered veh). The tickets were issued 2 days before I bought the car from the middleman who bought a car off craigslist to resell. Evidently he parked it on the street in front of his house without plates, how can I prove this. I insured, registered and titled it the same day I bought the car. I have no sales receipt of any sort. I’m not even sure about the date on the title he gave me since it was signed by the original seller but the buyer was left blank since he was intending to resell the car.

    Thanks for your response earlier. I can’t respond to your reply, so I’d have to leave a new comment. You mentioned in the post that the expiration of the registration has to be there. I noticed one of the tickets has it written as “N/S – Snow”. I think that means Not Shown due to snow, as the previous day it was snowing so there was some snow on the windshield. How does it work in this case?

  • Hi. I got a notice in the mail of a violation for standing at a bus stop 2/2. I was never issued a direct summons nor do I recall the offense. None the less when I looked the tix up online I notices the model year is wrong. Is that enough to fight the tix?

      The wrong mode and year are good defenses. Submit a copy of your registration when you make these arguments in your not guilty paperwork.

  • Dear Matt,

    I was recently issued 3 tickets for “No parking all times – temp construction regulation”. I went on a vacation, and the sign was put on when my car was parked there during my vacation. Before that, that was a legal parking spot. I received 3 tickets consecutively because of that. On the NYC DOT website, it doesn’t even show that this block has any “no parking anytime” sign in the database. It only shows “no parking 8am – 5pm except Sunday” sign for that block. Also, I went to NYC DOT Streets Permit management system website, there was no working permit issued or valid during the time of my ticket. Can I use this evidence to fight these tickets? Thanks!

      Give it a shot. You can also argue that you should not be penalized a multiple times for the same offense (especially given the change in the signage).

    Hi,

    I received a “No standing” parking ticket and a missing front plate ticket. Both tickets say N/A for Date/Time 1st observed, is this a defense for a invalid ticket? Also, there were no signs that said no standing and I have pictures of my car next to the sign that says Tuesday and Friday – no parking, I was there on a Monday. Thanks for you help

      The notation “N/A” for Date/Time 1st observed is not a valid defense. This field only applies to a traditional expired meter ticket.

      However, a prerequisite for a no standing ticket is an actual sign that prohibits such activity so this is a good defense (especially with a panoramic photo that shows the relevant street signs and street addresses).

  • I just got a No Standing ticket. I parked by a curb with No Standing sign to pick up my wife. I turned my engine off. Then I saw an traffic officer from rear mirror. I turned the engine back on. The officer walked by without saying anything. Engine remained on. 5 minutes later, the officer came back to give me a ticket. My wife returned to my car right when the officer was giving ticket. The ticket says, “Sitter refused to move parked. Engine off.” The ticket does not cite “Date/Time 1st Observed” (with “N/A” in the block), but does cite the “Date/Time of Offence”.
    What’s my possible defense for this? And chance of winning?

      The failure to insert the Date/Time of Offense is a strong argument. You can argument that the ticket is fatally defective without this information. However, the omission of “Date/Time 1st Observed” is not.

    We received a parking ticket and they listed the Make of the car as “NS”. I believe this means “Not Sure”? Do we have a chance at fighting the ticket? They have the plate number, color, and year correct. The ticket is for “No parking during street cleaning”.

  • On President’s Day, I received a ticket for 4-08(l)(3)(ii). I paid the MuniMeter but apparently the spot was limited to commercial vehicles loading and unloading M-F from 10-4. I honestly thought I could park there because it was a holiday, but I paid anyway because I always get nervous. Of the ten things you identify as rendering a ticket defective, the only thing I can point to is that the meter number was omitted. Will that do the trick for me, or does the fact that it’s a MuniMeter (not an old school meter) make a difference? Also, because I paid the MuniMeter, I have the Ticket ID, which lists the machine number. Should I omit the fact that I paid and therefore have this information from my defense?

    I got a ticket for a No standing at a bus stop, but it appears the officer thought the arrow was facing both ways for the bus stop which it was not. The location that I parked at was a metered spot and clearly not a bus stop. I also have the meter ticket as proof but the ticket expired 5 minutes before the officer wrote the ticket. Should I still use it as evidence along with pictures of the spot? Would it make my case better/worse? Thank you!

      I think the receipt helps you so I would use it. However, you should also submit a panoramic photograph that shows the street signs, street address and location where you were parked and ticketed.

  • Hi,
    My parking ticket (& related tow) do not accurately indicate where I was parked and I am 85% sure I was parked correctly for Tuesday street cleaning. The ticket indicates I was parked:
    “N/S Edgecombe Ave
    100 ft E/of W 156th St”
    A) There is no 156th Street on Edgecombe Avenue and B) How could I be east of West 156th Street, even if there were?
    I would think this is grounds for a dismissal, since it does not indicate where I was parked and one side of the street has street cleaning Monday and the other on Tuesday.
    Am I correct?

  • Is the VIN # required on a violation? I received a violation for illegally parking and have never been to NYC. I requested a hearing on line and submitted my vehicle registration & was found guilty. The make and model of the cars are the same, but the colors are different. The Judge said the vehicle color is not a “required element”. The Judge also stated that just because I claimed not to be in NYC on that date, doesn’t mean my car wasn’t.

    The only reason I can think of why our vehicles are the same except for the color is the officer must have run the VIN but transposed some numbers. I am now appealing the decision and submitting video of my vehicle entering and exiting my employer’s parking garage 1600 miles away.

    I received a ticket from a cop while i was in the car in park , and i was maybe blocking the crosswalk a little bit, the cop came over to me and issued me a moving violation of blocking traffic and a parking ticket for blocking a crosswalk , as well on the ticket it says that it was opposite an address that when checking that address it comes out to be like half a block down , and there is no crosswalk there, based on having a moving violation that shows i was driving and not parked , and based that there is no crosswalk opposite the address that was written on the ticket , if the address is a good reason for dismissal then what do i show to prove that there is no crosswalk by that address

      You should take photographs showing the location. Make sure that they include street addresses and street signs. Panoramic photos work well but, otherwise, you can submit a series of consequence photos showing the relevant stretch of roadway and signage.

  • hi, i received 2 parking tickets on 2 continues days.the first ticket was due to insufficient funds in the meter.i didn’t know the meter takes only 2 hours at a time so that was my fault but the 2nd ticket, i paid to the wrong meter because there was an arrow at where i parked pointing to a near by meter and i paid to that meter thinking it was the right one and when i got back i still had a ticket. i immediately called the ticket officer and told her i still have 15 mins on my slot and she said i paid to the wrong meter.please i want to know if i can plead not guilty because i paid for the parking even if i missed the meters up because i was new in that neighborhood.

    I got a ticket for parking in a no standing zone. Prior to me getting this ticket, I had been parking at this same spot for the past 2 years without ever having any issues involving tickets. However, the no standing sign was just recently placed. Also, I noticed that: the car behind me which was parked at the time, had no tickets on its windshield, and apparently it happens to be a no standing zone. Also the body type of my car isn’t on par with the body type of my car on the ticket. Please are there any chances of getting my case dismissed? I Live in the Bronx.

      The wrong body type is a strong defense. You should submit a copy of your registration showing the error with your not guilty papers or plea. The other issues that you raise do not help (in my opinion).

    Unfortunately, the car description ( except body type) match my car…

    I know this is probably a long shot, but I recently received 3 tickets on 3 consecutive days (Monday, Tuesday, Wednesday) for having an expired state inspection sticker. My car was street parked in Brooklyn and I do not drive it during the work week, so I did not see the first 2 tickets until I happened to walk by it Wednesday morning.

    I paid the first ticket immediately, but I would like to potentially dispute the other 2 tickets, since 1) it is not reasonable to expect that I could have seen the ticket the day it was issued and 2) I was not given any time to remedy the issue. I frequently work late hours and it is not feasible for me to go get a state inspection done anytime during a weekday. I went and got the sticker renewed first thing Saturday morning.

    I was planning to present the payment receipt for the first ticket to show that I paid it immediately and the state inspection paperwork to show that I took care of the issue as soon as was feasibly possible.

    Would really appreciate your insights on this!

  • Hello! My car was towed from a “No Standing” zone (after being booted for 2 hours). There was no ticket on my car when I picked it up from impound and I can’t find a ticket in the online system. It has been 1 week since it was towed. If they didn’t issue a ticket can I fight the tow fees? How would I fight them if I don’t have a court date because I have no ticket?

      It sounds like the ticket blew off (or was removed) from your windshield. My best guess is that it will “hit” the NYC Dept of Finance system shortly. Keep checking.

  • I have a question.
    I recieved a ticket In a mail. The ticket is for parking In front of the fire hydrant.
    I was in shock to getting mail like that as I never drive to the city. Saying that, someone put my plate numbers (probably in error) into the system and now I am getting ticket to pay for someone else ticket. The ticket is already for $125.00
    the day when this ticket was issued my car and I was 40 miles away from the New York City.
    I do have ez-pass account and I can show that that day I did not cross any bridges or tunnels to get into the New York city. Would that help? How I can defend myself. I don’t want to pay for someone else and for something I didn’t do.

      Yes, your EZ pass records sound like they will help your defense. Also, check the ticket (get it online) to see if the car description matches your vehicle.

  • Hi I received a $115 parking ticket for double parking. It was the day after the big 28 inch blizzard and I had to run into CVS to get some medication. I circled the whole neighborhood for a half an hour and I couldn’t find any spots because the city’s snow plows shoved all the snow to the curb,blocking every possible spot to park in the entire vicinity.There were many spots available but I obviously couldn’t get into any of them because the city put all the snow there. So I was forced to double park. Do You think I can dispute and win?

    I received a parking ticket for parking a commercial vehicle overnight on the street (4-08(k)(6)). While no sign was posted, it seems that this is a rule that people are just supposed to know. In my case, it was a rental van so I was not aware of this rule.

    In any case, I’m prepared to pay the fine of $65, but thought I’d check with you first. The ticket does not contain a meter # which, according to your article, could be grounds for a defective ticket defense. I know its a long shot, but any chance this is a valid defense?

  • For several months now construction material has been taking up about 2 ½ parking spaces on my street. Because of this, cars can only backup to be about 6 feet away from the hydrant. For several months now, I have seen many cars park there , overnight and even for days on end, I walk by just about everyday and not seen a parking ticket. Even on days when parking rules are in effect on the other side of the street and parked cars are ticketed. I have also been parking at that spot close to the fire hydrant when there is no other spot. Yesterday I got a ticket. Is there a way to dispute it, given that the construction site is blocking the space (and they don’t even have to move on alternate side days)?? There is little parking in our area, if I can’t dispute this ticket, is there a way I can get the construction people to stop blocking more than their share of the block?

      I doubt that you’ll beat this ticket. In regard to the construction people, you would have to file a complaint with the appropriate agency (likely the Dept of Buildings).

    I was given a $115 ticket for double parking in front of a fire hydrant. There was no space to park in front of my building in order to load my baby and son into my car. The street is not wide enough to double park next to park cars so I parked it by the fire hydrant to quickly get my kids from inside of my building. I came out before the officer scanned the sticker on my car. I said please to her but she went ahead, scanned the sticker and printed the ticket. Is there a way to fight this? Thanks

  • Hi… I NEED HELP!

    I dropped off and picked up my boyfriend from the bank. It so happens to be the bus stop was also there, i dropped him up in the end of the block where the bus stop ends, I put on my emergency lights and just when I was going to pull out the cop light goes on. I was trying to explain to the officer i was picking someone and was leaving and I was on a phone call and didn’t want to get on the road until I was done. There was also people parked RIGHT ON THE BUS STOP, but he still gave me the ticket. It is my first ticket, what should I do??!?!?! Should I fight it?

    So okay maybe the bus lane thing isn’t a valid reason to fight the ticket…
    But after reviewing this page more carefully, and examining my ticket, I noticed a few things left empty such as the Time 1st Observed, Days in Effect, and the make of my car being wrong(not sure if this is valid or necessary)
    Do these still apply to a parking violation with my situation regarding the bus stop zone?
    Should I still try to fight this?

  • Hi so I was parked on 43rd st on a Sunday about 2 weeks ago. It was snowing that day.
    So I park right before this bus sign but there was a line that stopped right where the bus sign started.
    I was parked well before the line stopped and there were cars in front of me as well. However only I got ticketed… I took a video that included the bus sign, where the line stops, where my car was, and across the street just to be safe. The only other sign along the street was a sign that says No Parking except on Sundays, which it was.

      A NYC bus stop zone begins at the bus stop sign and extends in the direction of the arrow(s) until the next parking sign or the end of the block. For a NYC bus stop parking ticket, it doesn’t matter if you parked far enough away from the sign for a bus to fit.

  • Hello, I hope you can advise me. I went online to pay a ticket, and I was dismayed to see another ticket listed on my license plate, one from 12/8/15, that I never even knew that I received. Based on the online image, it seems an officer ticketed me for double parking when I was picking up my son from school. I wasn’t parked – I merely stopped for a moment to let him into the car. The officer didn’t even hand me the ticket. Now almost 2 months later, I am looking at the details. In the Exp.date box it says N/S-DrOff. In the year box it says N/S. In the color box GRY – while my car is BLUE. Do I have any valid defense based on the information I provided?

  • On Saturday, we misread a sign that says “Commercial Vehicles Only others no standing 8am-7pm Except Sunday” and bought a meter ticket for 1 hour. After coming back within an hour, our car had a ticket and a boot (we already paid for the boot removal). We do not have a commercial vehicle. The ticket says “in Violation of NYC Traffic Rules, Section: 4-08(I)(3)(ii)”. After looking up that violation, it reads, “(ii) No person shall, in any parking space controlled by a “Muni-Meter,” park a vehicle without displaying a payment receipt in the windshield, where such requirement is indicated by posted signs.” We have video of the payment receipt in the windshield and still have the payment receipt. Since we do have proof of us not violating Section: 4-08(I)(3)(ii) with the video footage, do we have a case in court even though we didn’t follow the sign?

  • On 02.02.2016 06:06PM Parked in front of 611 Manhattan Ave Brooklyn N.Y. 11222 and Preceded to the closes Muni-Meter #3223010 to pay for parking, I was unable to purchase a ticket. The machine was not lit and could not read the display after shining a flashlight at the meter displayed MACHINE OUT OF ORDER.
    Next closest meter was across the street. While at 2nd Muni-meter #3223013 trying to purchase a ticket and unsuccessful as the 2nd machine is broken. The next closest meter I could see was on the Next Street I walked to the 3rd Meter #3223014 and finally was able to purchase a ticket #32988 at time 06:21PM once I got back to the car I questioned the traffic agent as to why did she issue a parking violation and told her that both Muni-meter machines are broken on the block she ignored me and continued to write summonses to other vehicles on the block. As the traffic agent’s only concern was to rack up as many tickets as possible and did not care that the Muni-meter machines were broken on both sides of the street.

    I suspect that the Traffic Agent was well aware of the Muni-Meter being broken as to other people on the street stated that the meters were broken for 2 days already and traffic agents were doing same thing the other day. From observing as the way the summonses were issued and the Intentional omission of Critical information makes me believe the traffic agent was aware of broken muni-meters.

    1. I is impossible to display a paid parking ticket on a dashboard when both machines on the block are broken in 5 minutes, the traffic agent did not state the time first observed either.
    2. 2 broken Muni-meters meters on the block
    3. Sections of parking ticket are missing critical information to summons and were omitted intentionally: Meter #, Operational, Limit, DATE/TIME 1st OBSERVED missing. I suspect there were not entered because of the knowledge of broken meter’s meanwhile issuing summonses.

    I received a parking ticket which states I am parked in a no standing zone. It was a sunday, and free parking on all streets. 90% of my vehicle was on the correct side of the sign. About 1 foot of the rear of my vehicle was past the no standing portion of the sign. I was not obstructing any walkways or traffic lanes. Should I fight this ticket?

      Yes, an incorrect address (location on ticket) is grounds for an expired registration ticket to be dismissed. You, of course, need to prove the mistake, however, with photos or other evidence.

    I received a ticket for parking in a no standing zone because the sign that should be there was hit by a car over a year ago and still has not been replaced by the city. The sign would have shown that I was parked in a legitimate spot. Went to court today showing google maps print outs that show the sign still there and the “judge” still found me guilty. Is it “innocent until proven guilty” or “guilty until proven innocent”. Is something like this even worth trying to appeal?

    I just received a ticket for 4-08(I)(3)(ii), in the violation of NYC it states “No Std Com Mtr Zone.”

    Date/Time 1st Observed is N/A
    Meyer #/Operation/Limit is empty

    I bought a ticket just to be safe as I was losing and unloading. Additionally, I had my hazards on during this. Is it worth fighting or not?

Even though the judge said that placing the registration sticker on the dashboard is not allowed since it is supposed to be attached to the window, I explained the situation. He took a look at my evidence & dismissed both tickets. Thank you for advising me to fight it. You helped save me from 2 tickets, both worth $65.

  • I received a ticket for failing to display a muni-meter. The violation box says EXCEPT SU 9A – 7P. This is technically incorrect, since muni meters aren’t required 24/7 except the time listed on the ticket, but rather during all days except Sunday, during those limited hours. Is this a defense?

    Second, the happy warrior printed (as opposed to signed in cursive) his first name only, while the typed name is the last name and first initial. In other words, the “signature” doesn’t necessarily reflect that “typed” name. Is this a defense?

  • Today I received a parking ticket in my car which was running with the hazard lights on across the street from my house. The zone is no parking 8-6. I was there no more than 3 minutes to bring bags of groceries into my house. The traffic agent observed me doing this then managed to write me
    A ticket and jump back in his car during my last trip into my house with bags. Any chance at getting out of paying this? This is the most underhanded ticket I’ve ever received as my block rarely has parking and this is the only way to unload groceries.

    Today I got a 50$ parking ticket for parking in a “Permit Only” parking area. The sign was partially obscured due to recent snow storms and I did not see it. I was only parked in the zone for 10-15 minutes.

      The length of time illegally parked is irrelevant. If the sign was obscured substantially enough to render it no readable and you have proof (photos of the sign), then you may be able to beat it.

    Everything is filled out correctly except in the time section AM or PM is not marked. The time is marked 08:55. Is that sufficient or do I have a case that the time was not correct?

  • Hi I just got a ticket in a no standing zone. I was only there for like not even 5 mins so my daughter could run in and say hi to her cousin who she hasn’t seen in over a yr. I went out and into the car put the key in the ignition as I was unlocking the door for my child and the traffic cop lady slammed a $115 ticket on my windshield with me in the car. She put the ticket as unattended but if u put the ticket on while I’m in the car then u have to change that yes ? Date and time first observed says n/a color of car pur which only color I know pur to stand for is purple. The car is gold which is the original color of the car. So how you can confuse pur with gold? Next to plate # box it has a box named CD. What does this mean? Because she put ns on there . She also put ns on the year of the car. This is a computerize ticket so shouldnt they know these answers ?Plus to make it worse she drove off with no headlights on which definitely can cause a real accident and it was dark . We in the winter months and 5:18p in the Bronx on 1/22/16 it’s dark already and you need your headlights on . Is there any chance of fighting the ticket ? Car is another state because was borrowing someone car .

    You are a Godsend! I am a 73 yr. old woman who lives in CT. I rarely drive and park in Manhattan, but am taking a weekend course on the west side for several months and have been driving in and parking in the mid-thirties between 8th and 9th Avenue without a problem. I was told by the people running the course that parking rules were suspended on weekends. I now know that that does not apply to the red Standing signs! I happened to go and put something in my car during lunch hour on a Saturday a couple of weeks ago and they were towing my car. They allowed me to get my registration and insurance info but still towed the car away. When I went to pick it up (which was immediately afterwards,) they charged me $185 for booting and $185 for towing. I didn’t know what booting was and they had to explain it to me. Since then, people I know that live and drive in the city said that booting was usually for people with pre-existing traffic violations and people that didn’t pay up. That would not be me! I hardly ever park in NY. The ticket is completed and I realize that I had the wrong information, but that’s my responsibility, but I would like to get the booting fee back. Who even deals with that? The van driver who took me back to my car was appalled and said I should talk to a supervisor, and when I did it went nowhere. Any suggestions?

      Your vehicle can be booted for owing the city more than $350 in parking ticket or camera violations that are in judgment. Since you were not in this situation, it seems like you should not have been booted and should be able to obtain your boot fee back.

  • hello,

    i received a ticket recently for a missing license plate (front end). when i saw the ticket, i was utterly confused, and found that someone had hit and broken the plastic bracket holding my front license plate, and the piece, including my plate, was on the ground right beneath the front end of my car.

    i’m not sure there’s any way i can prove that, but the bracket is now attached to my car using wire to hold it on. also, the traffic ticket says N/A under Date/Time 1st Observed.

    do i have any shot, or should i just take the loss and pay the ticket?

  • I live in NYC, but I bought my car in NJ. At the time of delivery, I was given my NY registration & was told that I needed to get an inspection in NY since the dealer couldn’t obtain a NY inspection for me. I was given a temporary inspection pass that was valid for 10 days. I was told by the dealer that I was not allowed to place the registration sticker on my windshield until I got my inspection. Therefore, I placed both the registration sticker & the temporary inspection pass on my dashboard on the driver’s side. The temporary inspection sticker covered me until 1/16/16. On 1/13/16, I came out to find 2 tickets on my car for missing registration sticker & for missing inspection sticker. Since I was within the 10 day grace period allowed by the temporary pass & since I was instructed not to place the registration sticker on my windshield until I obtained the inspection, is this grounds for dismissal? I still have the temporary pass that shows the expiration date. I also have the receipt from the place that I eventually did my inspection that proves that I did it on 1/14/16, which is within the grace period.

  • can the 1st observed defense be used to dismissed a parking ticket that was given because of alternate side street cleaning regulations, or is it strictly for parking meters?

    I got a ticket over night on an early Saturday morning (1:08AM) for being parking in a Temporary No Parking Construction Zone. I parked at 7PM the day before, Friday. The entire street block had cars parked on it, which is why I didn’t think twice about parking there, and to date, cars continue to be parked there over night.

    In addition, the officer has the incorrect make of my car written in.

    Do I have grounds for a Not Guilty plea based on these 2 items?

      The incorrect make is a strong argument (the other one is not). Submit a copy of your registration showing the error with your not guilty plea.

  • I got a parking ticket this morning for $115. The reason is I was at a No Standing Bus Stop but the truth is I was an inch over the bus stop post while parked properly where I was allowed to. They got all the info correct except I have a Honda and they put down Lincoln. If it helps, they crossed out the place of offense and wrote again on top of it.

    What should I do? I am from New York City.
