Once you are convicted of a moving violation in New York, there are only two ways to deduct points from your license. One involves time and the other involves education.
But first lets discuss briefly how the New York point system works. You are generally allowed up to 10 points on your driving record within 18 months (based on dates of offense). At 11 points, your driver’s license can be suspended. For more details about the points system, read my post entitled “How Many Points Am I Allowed On My New York Driver’s License?“
So once you are convicted, are there any ways to get those points deducted? The answer is “yes”. One involves the passage of time. After 18 months counting from the date of offense, you will no longer have those points vis-a-vis new, future tickets. That is, convictions 18 months or more apart (based on date of offense) are not added to one another. Note: For insurance purposes, convictions count against you for 36 months based on the date of conviction.
How Many Points Does Defensive Driving Take Off In NY?
The other way to deduct points is to take a 6-hour New York State Driver Safety Class. You can take such a Class once every 18 months and you can take it online or in-person.
The NYS Driver Safety Class does not technically remove the conviction, however. Instead, the class deducts up to 4 points from your current total (while leaving any convictions visible on your record). The class will only deduct your point total for convictions that have dates of offense that are BEFORE the date of completion of the class counting 18 months back. It is for this reason that we often recommend to our clients with point issues to take this Class before they are potentially convicted of any open moving violation that could put them at 11 or more points. They will get credit for the Class even if they are convicted of this traffic ticket afterwards. Stated differently, as long as the date of offense precedes the Class by 18 months or less, then you will get credit for the Class vis-a-vis that traffic ticket (even if you are convicted of that ticket after you complete the class). However, you will NEVER get a credit for future tickets (i.e., ones that are issued after you complete the Driver Safety Class).
Finally, you can only take the New York State Driver Safety Class once every 18 months so we recommend that save it for those instances when you either already have 4+ points on our record (so you get the full benefit) or when you are facing a possible suspension for too many points.

hello i have a question on how point reduction works, i currently have just received my license back after having it revoked for 6 months on 3 speeding tickets that are almost 3 years old, which i served 6 months suspension at the time of receiving the tickets. so total i have served 12 months total for suspension for 3 tickets, have taken 2 PIRP courses which have not done a single thing. I currently have 13 points. also i want to add the second time my license was suspended i had no warning or any idea my license was revoked, also i was told the second time was because i have 3 speeding tickets in 6 months which was originally true, but 1 ticket i couldn’t get a court date till several months later, i settled the ticket and then that is when they suspended my license the second time without telling me. even though i have not got any new tickets.

I got a ticket on 1/25/19, plead not guilty and rescheduled the hearing over again until 10/4/22. If I choose to plead guilty now and pay the fines, will the points appear on my record ? It has been over 18 months since the violation date

If you plead guilty, the points will be added to your license (retroactive to the date of offense). Even though it has been more than 18 months, DMV will add these points to whatever points you have already (those within 18 months of that date of offense) and penalize you accordingly.

I received 6 points on my license. Took the defensive driving course. It was reported to the NYC DMV. I just looked at my driving record. Hi—I have a trial date on Tuesday for a speeding ticket received in 2018 coming off the Brooklyn Bridge into Brooklyn, leaving a 35 mph zone to a 25 mph zone (1-10 mph over the limit ticket). There was a speed trap waiting just after the off-ramp, perhaps 1 block at most. Is this worth fighting? It is sufficiently delayed that the points will not matter as it is more than 18 months and no further violations. Question again is, is this worth fighting with such slim chances of winning an dismissal? Thanks.

Assuming you have an otherwise clean record, you can fight this one or just pay it. It is a low speed which, alone, will not affect your insurance rates and it it apparently only carries 3 points. (“1=10 mph”).

I currently have 6 points on my license related to a violation dated 12/12/20, so I understand these points will expire in the next 5 months.
I got another ticket for speeding 82 where 55 is allowed with the violation dated 4/10/21. I pleaded guilty to this (as at that time I didn’t have the 6 points yet from the prior violation) but still have to pay the fine. I understand this second violation probably also carries 6 points, however it is not yet shown on my record. Is it correct that the points will only be added to my record after I have paid the fine?
What would be the best approach for me regarding this? Should I try to delay the payment of the 2nd violation so that by the time the points get added to my record, the points from my first violation have already expired? Or would it be better to take the defensive drivers course now so that the 6 points from my first violation get reduced to 2, and I have enough space to incur an additional 6 points. Understand that if I take the course now, and I do get an additional 6 points for the 2nd violation, I will have 8 points for the next year without having the opportunity to reduce it by taking the course again.
Any advice would be much appreciated.

The points are added to your license as soon as you plead guilty (or are found guilty).
Take the Driver Safety Class ASAP! Delaying does not help avoid a suspension for too many points. As my article states, points are based on the date of offense.

I pleaded guilty to the 2nd violation more than 1 month ago, and right now there are no points on my record for that violation.
For the first violation I went to court on 1/18/22, and my record has 6 points already for that violation.
Could it maybe be that the court related to my 2nd violation forgot to submit the paperwork to the DMV, or that it still needs to be processed by the DMV (even though my first violation seemed to have been processed in less than 1 week)?

An improper left hand ticket carries 2 points but the class will remove up to 4 points.
Assuming you have an otherwise clean record, I recommend saving the class for when you really need it. You can only take it once every 18 months.

Good question. My best guess is that DMV will match up your ID with your Driver’s License’s number. If so, you will be assessed the 5 points.

Hi Mr.Weiss, I recently got three moving violations. They were for speeding 25mph over the limit, failure to obey traffic signals (speed limit sign) and “careless driving” which I think was bull. Googled this for NY and this came to the top! Have the same question as Chris above ^. I have 2 completed points reduction courses on my DMV record, 1 of which is completed within 18 months (after) of a ticket that may get my license suspended, for a moving violation. Just wanted to find some kind of confirmation that the judges in North Brooklyn will actually take the completed courses into account as I drive all over the Northeast for work. Sam, yes, you should be credited for the 4-point deduction for the NYS Driver Safety Class taken by you after the issuance of your pending ticket (as long as you took it within 18 months of the ticket’s date of offense).

Because your Nov 2015, 4-point speeding ticket was issued within 18-months of your prior Feb 2015 6-point speeding ticket, the two convictions would be added together to give you a total of 10 points. The fact that you were convicted much later (May 2017) is irrelevant. The dates of the offense are what are controlling for purposes of calculating DMV points.

It’s deceiving to use the term “remove” points when in reality nothing is removed. That’s why the DMV’s literature uses the word “reduce” which is more accurate.

1st speeding ticket in 15years, no other moving violations. In NYC ,ticket issued for going 50 on a 30mph off ramp.
Have a clean CDL. Concerned about points.
Not sure what’she the best course . Plead guilty on line and play fine.
2) go to court plead guilty ask for reduction in points if that is done.
3) contest ticket ,no deposition by officer issued. If found guilty,pay fine and then ask for point reduction. Being aware will loose day of work for court appearencephalitis.

You should plead not guilty as this is the only way to possibly obtain a more favorable result. This carries 4 points and can adversely affect your insurance rates. Given your otherwise clean record, you likely can get this negotiated down to a less serious charge. If you cannot or do not want to travel to the court, then you can retain a NY traffic ticket lawyer to appear for you.
